Terms of Service for NJ Business Index

1. Acceptance of Terms

B. Listing Submission

When submitting a business listing, you represent and warrant that:

1.You are the authorized representative of the business or have the authority to submit the listing.

2.All information provided is accurate, truthful, and complete.

3.The content is not illegal, obscene, defamatory, threatening, infringing of intellectual property rights, or otherwise injurious to third parties.

4.The listing complies with all applicable laws and regulations in New Jersey and the United States.

C. Free Listings

The Service currently offers free listings for all eligible businesses. We reserve the right to introduce paid services or features in the future, but will provide clear notice and obtain your consent before charging for any service.

D. Prohibited Conduct

You agree not to use the Service to:

•Post false, misleading, or fraudulent information.

•Impersonate any person or entity.

•Transmit any software or other materials that contain viruses, worms, or other harmful or disruptive components.

4. Intellectual Property and Content License

A. User Content

You retain all ownership rights to the content you submit to the Service (your “User Content”). By submitting User Content, you grant the NJ Business Index a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to use, reproduce, distribute, prepare derivative works of, display, and perform the User Content in connection with the Service and the NJ Business Index’s (and its successors’ and affiliates’) business, including without limitation for promoting and redistributing part or all of the Service (and derivative works thereof) in any media formats and through any media channels.

B. Service Content

All content on the Service, excluding User Content, such as text, graphics, logos, and software, is the property of NJ Business Index or its licensors and is protected by intellectual property laws.

5. Disclaimer of Warranties

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. THE NJ BUSINESS INDEX DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE. WE DO NOT ENDORSE OR WARRANT THE ACCURACY, RELIABILITY, OR QUALITY OF ANY BUSINESS LISTED ON THE SERVICE. YOU ACKNOWLEDGE THAT ANY RELIANCE ON BUSINESSES LISTED ON THE SERVICE IS AT YOUR OWN RISK.

6. Limitation of Liability

IN NO EVENT SHALL NJ BUSINESS INDEX, NOR ITS DIRECTORS, EMPLOYEES, PARTNERS, AGENTS, SUPPLIERS, OR AFFILIATES, BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM (I) YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SERVICE; (II) ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE SERVICE; (III) ANY CONTENT OBTAINED FROM THE SERVICE; AND (IV) UNAUTHORIZED ACCESS, USE OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE) OR ANY OTHER LEGAL THEORY, WHETHER OR NOT WE HAVE BEEN INFORMED OF THE POSSIBILITY OF SUCH DAMAGE.

These Terms shall be governed and construed in accordance with the laws of the State of New Jersey, United States, without regard to its conflict of law provisions.
